The real property transfer tax rate is $1.95 per $500 or portion thereof of cash value.

The County Recorder will charge and collect an additional $25 for documents that do not meet the requirements.

Document Formatting Requirements

* A document submitted for recording must be on 8.5 x 11 inch white 20# paper. Individual pages should not be bound together at the top, sides, or bottom. There should not be any additional materials or attachments physically attached to the paper.

* All documents and exhibits must be clearly readable and on paper suitable for permanent record imaging.

* Printing should be single-sided only, in black ink, Times New Roman, and at least 10 point font. Do not use any colored markings or highlighting.

* Corresponding names must be typed or printed beneath signatures, except for notaries and witnesses.

* The notary stamp or seal should not overlap with any text or signature on the document, except in the case of a validated stamp or seal of a licensed professional engineer or land surveyor.

* On the face of the document, provide the name and address where the document should be sent after recording.

* In the upper right corner of the first page, include a 3 x 3 inch space. This space is necessary for the recorder's stamp. All other margins on the first page and on subsequent pages should be at least 1 inch.

* Below the 3 x 3 inch space, provide a document title.

* Any conveyance of real property or instrument in writing that sets forth an agreement to convey real property must contain the mailing address of the grantee. If there is not a grantee, include the mailing address of the person who is requesting the recording.

* In the top left corner of the first page, provide the assessor's parcel number of the property. A document relating exclusively to the transfer of water rights can be recorded without an assessor's parcel number.

* The County Recorder will not record a deed unless it contains the name and address of the person who should receive the property tax bill.

* A legal description of the real property is required. The assessor's parcel number is not a complete legal description. If the legal description is in metes and bounds, include the name and address of the person who prepared the legal description, or state the document number from which the description was obtained. The county recorder is not required to verify the accuracy of the information concerning the previous recording.

* If a document is being re-recorded or is a correction document, provide the following information on the first page: "Correcting document #:____________, Amending: ___________, and the reason for re-recording:_________________." For a re-recording, all pages from the original document must be included, and a $25 non-conforming fee applies.

* Personal information must be removed prior to recording, unless an applicable state or federal law requires the inclusion of such information. If this information is required, the following affirmation statement should be on the first page: "The undersigned hereby affirms that this document submitted for recording contains personal information as required by law." This should be followed by the specific law that required this information, as well as the signature, printed name, and title of the document preparer.

DECLARATION OF VALUE

A Declaration of Value form is necessary for any document that transfers interest in real property whether transfer tax is due or an exemption is claimed. This form enables the Recorder's Office to effectively administer transfer tax. A conveyance of real property must contain a completed Declaration of Value. Incomplete forms will be returned unrecorded.

It is preferred that both parties sign and complete the form, as both the seller/grantor and buyer/grantee are jointly and severally responsible for payment of transfer tax. If the seller/grantor or buyer/grantee does not sign the form, the person signing is required to identify themselves and their capacity.

If an exemption is claimed, include the exemption number and an explanation of the exemption on the conveyance document.

If someone other than the grantor or grantee is requesting the recording, the "company/person requesting recording" section must be completed on the Declaration of Value form.

A cover page can be used. It will be counted as the first page of the document.
