Non-standard documents will be charged an additional $25 per document penalty. Non-standard documents meet statutory requirements but not formatting standards.
Exempt documents that meet statutory requirements but are exempt from the formatting standards will only have the per-page recording fee.
If a document releases or assigns more than one item, there is a $5 per each additional item charge.
Document Formatting Requirements
* Use 8.5 x 11 inch white paper. The paper should be standard copy weight, which is 20# bond. It is available at office supply stores, drugstores, etc. The paper should not have any watermarks or logos.
* Printing should be in black ink and on one side of the page only. A minimum font size of 8 point is required. Use a standard font, such as Times New Roman for readability and legibility. Non-essential information within margins is exempt from the size and color requirement. The Recorder is not liable or responsible for insuring that non-essential information is archived. Page numbers, form numbers, and return addresses are examples of non-essential information.
* Do not use continuous forms or permanent binding on multiple-page documents. However, documents may be stapled together for presentation for recording.
* All signatures must be in dark or black ink to ensure that they can be reproduced. Underneath signatures, the signor should print, type, or stamp their name.
* Do not include stapled or taped attachments to the document. A securely attached bar-coded label may be attached. "Attachment" does not refer to an exhibit but additions to a document page.
* The top 3 inches of vertical space on the first page is designated for the Recorder's certification. All other margins on the first page and subsequent pages can be a minimum of 3/4 of an inch.
REQUIREMENTS FOR THE FIRST PAGE
Every document (except plats and surveys) should contain the following information on the first page, below the 3-inch margin:
1. Title of the document.
2. Date of the document.
3. All grantors' names. Grantors' names must be designated in order to be indexed. There is no limit as to combinations or exclusions, but the word "grantor" must appear. It is the filer's or preparer's responsibility to make the designations.
4. All grantees' names. Grantees' names must also be designated.
5. Any statutory required addresses. Statutory addresses must also be designated (i.e. "Grantee's mailing address is...")
6. Legal description. The address of the property is not accepted as a legal description.
7. If required, provide reference book and pages. These must also be designated.
If there is not enough room on the first page for items 1-7, provide the page reference within the document where the information is given. If one of the required fields begins on the first page and continues uninterrupted to the next page, it will meet the first page requirements. A cover page is not required, but if one is presented it will be recorded as the first page. If a cover page is used, it needs to have the 3-inch top margin and the first page designations. If presenting a document for re-recording, in addition to all other requirements, it must have a new first page or cover sheet, the 3-inch margin, and required designations.
Any document where one of the original parties is deceased or incapacitated is exempt from the requirements.
All documents that are rejected will be returned with a reason for the rejection.
