The office of the Recorder of Deeds is responsible for maintaining real property records in Cedar County.

Recording Fees

Fees must be paid before recording can take place.

Documents that meet the statutory requirements but are exempt from the formatting standards will have only the per-page recording fee applied.
EXEMPT DOCUMENTS FROM THE FORMATTING REQUIREMENTS
*Documents signed prior to January 1, 2002
*Military separation papers
*Documents executed outside the United States
*Certified copies of documents, including birth and death certificates
*Any document where one of the original parties is deceased or incapacitated
*Judgments or other documents formatted to meet court requirements
*Fixture Filings on the National Approved UCC Forms.

For a document that releases or assigns more than one item there is a $5 fee per each item.

A document that is rejected will be returned with an explanation.

Copies of recorded documents are $2 for the first page and $1 for each additional page of a document. Certification of a copy is $1.

In order to provide for the timely recording of documents, the Cedar County Recorder does not offer refunds for overpayments of documents. A document must be accompanied by the correct recording fees or it will be rejected until the correct amount is given.

Document Formatting Requirements

* Use 8.5 x 11 inch white paper without visible watermarks or logos. Do not use
continuous forms or permanent binding. However, documents may be stapled for presentation for recording. Attachments to a page may not be stapled or taped other than a securely attached bar-coded label or than as required by law. Attachment does not refer to an exhibit but additions to a document page.

* Printing should be in black or dark ink on one side of the page only in a minimum font size of 8 point. Non-essential information within any margin is exempt from the font size requirement. Signatures must be in black or dark ink to insure reproduction from record. Corresponding names must be typed, stamped, or printed beneath signatures.

* On the first page, provide a blank 3-inch top margin. This is designated for the Recorder's certification. All other margins on the first and subsequent pages should be a minimum of .75 of an inch.

* Non-essential information contained within the margins does not have to comply with the 8-point font requirement.

* Documents must be signed by the grantor and proved or acknowledged.

* The selling price of real estate is not required on recorded deeds in Missouri.


FIRST PAGE REQUIREMENTS

The following information should be given on the first page, after the 3-inch top margin:

1. Title of document.

2. Date of document.

3. Names of grantor(s). Grantors and grantees must be designated in order to be indexed. There are no limits as to combinations or exclusions, but the words "grantor" and "grantee" must be included. It is the preparer's responsibility to make these designations.

4. Names of grantee(s).

5. Addresses of grantor and grantee. Statutory addresses must also be designated in order to be indexed (i.e. grantee's mailing address).

6. Legal description (this can be included as an attachment.) The address of the property is not accepted as a legal description. If the legal description is given as an attachment, the words "see exhibit 1" can be included.

7. Reference book and pages, if applicable. If a book and page number is required, it must also be designated.

If there is not sufficient room on the first page, the page reference within the document where the information is set out can be stated on the first page. If one of the required fields starts on the first page and continues uninterrupted to subsequent pages, this will meet the first page requirements.

A cover page is not required, but if one is presented it will be recorded as the first page. The cover page, if used, must also have the 3-inch top margin and first page designations.

If a document is presented for re-recording, there must be a new first page or cover sheet with the 3-inch margin and first-page designations, in addition to all other requirements.

A document where one of the original parties is deceased or incapacitated is exempt from the formatting requirements.

Instruments are not valid until recorded: No such instrument in writing shall be valid, except between the parties thereto, and such as have actual notice thereof, until the same shall be deposited with the recorder for record.
