A certification of trust is a document that contains relevant details about an established trust containing real property. It is governed by Texas Property Code Sec. 114.086. A certification of trust validates the existence of the trust by identifying its full name, the date it was established, the names of the settlor (grantor) and trustees, the trustees' powers, and other details as needed. This is important because it allows the actual trust agreement, which is generally not recorded, to remain private.

The form is executed by the trustee and signed by the trustee and grantor (who can be the same person) and recorded in the office of the county recorder in any Texas county in which all or a portion of the real property is located. In order to facilitate a transfer of real property into a trust, financial institutions may require the trustee to furnish a certification of trust. In addition, third parties may request a certification of trust to confirm the trustee has the authority to transfer real property out of the trust.

The process was fast and efficient. I did get a bit confused after entering info for my package but soon realized I had completed this part of the process and only needed to leave the page and wait for review of the document and then the invoice. The guide I needed was very easy to understand and the template was easy to complete. I had a property attorney review the deed before I had it registered and she was impressed. Lee County, FL did accept the "Satisfaction of Mortgage" form. It was easy to fill out except for a couple of areas. Your fill in areas need to accommodate for whatever space needed for the pertinent information we as customers have to fill out. As individuals, banks have their own. Example when there are more than 1 party and information needed. Example of Document #; I was 1 number short (using Exhibit A was ridiculous.) So I had to write in the # after printing. Very unprofessional looking on a legal document. Just saying. Also, in Lee County, FL your document # is called "Instrument #, not said in your instructions. Hope this information helps for updates on your forms.

I love deeds.com - hands down, the quickest way to record a warranty deed. The process and communication is so quick - the recording transaction too. Worth the extra $20 to me for my time! I didn't spend over an hour driving around, talking to someone via a kiosk to record the deed, didn't have to spend the energy of loading kids into the car to come with me, etc. The efficiency and timely process is worth the cost! Love having this available! The whole process via deeds.com took less than 5 minutes to upload a document and less than 3 minutes to pay the invoice shortly thereafter.
