Releasing a Mechanic's Lien in Tennessee

Lien claimants must grant releases when the lien is no longer effective because it has been paid off or for any other reason.

If a lienor whose lien has been forfeited, expired, satisfied or adjudged against the lienor in an action on the lien, fails to cause the lien provided by this chapter to be released within thirty (30) days after service of written notice demanding release, the lienor shall be liable to the owner for all damages arising therefrom, and costs, including reasonable attorneys' fees, incurred by the owner. Tenn. Prop. Code 66-11-135(a).

A valid release form under this section identifies the parties, the location of the work or improvement, a reference to the recorded notice of lien, relevant dates and payments, and any other information necessary for the specific situation.

The lienor must file the release in the office where the notice of lien was recorded. Tenn. Prop. Code 66-11-135(b). The fee for recording shall be the fee required for the recording of a release or satisfaction of a mortgage as provided by law. Id. The lien shall be deemed released on the day on which the release of the lien is recorded in the proper office. Tenn. Prop. Code 66-11-135(c).

Forms used, created quitclaim deed that the county accepted without a second look (turns out they see deeds.com forms regularly via erecording and in person). Will be back for any real estate related forms I need and they carry. Will always be my first stop. Also, will use erecording next time, mad I didn't see it this time.

Lee County, FL did accept the "Satisfaction of Mortgage" form. It was easy to fill out except for a couple of areas. Your fill in areas need to accommodate for whatever space needed for the pertinent information we as customers have to fill out. As individuals, banks have their own. Example when there are more than 1 party and information needed. Example of Document #; I was 1 number short (using Exhibit A was ridiculous.) So I had to write in the # after printing. Very unprofessional looking on a legal document. Just saying. Also, in Lee County, FL your document # is called "Instrument #, not said in your instructions. Hope this information helps for updates on your forms.

The process for obtaining document itself was easy, and the included guide and example are great! rnI do have an issue with the format itself, though. The form has pre-defined text boxes, which cannot be altered without partially rebuilding the entire document. For the 'property description' field on the Mineral Deed form, the text box is not large enough for the rather lengthy legal description entered on my original plat.rnFortunately, I have a copy of Adobe Pro, so I have been able to re-build the doc to accommodate this short-coming.

Our forms are designed to adhere to specific formatting requirements that are often mandated for legal compliance. Making direct alterations to the document can result in them becoming non-conforming, which is why we advise customers to use an exhibit page when their legal description is extensive or does not fit.
