North Carolina Preliminary Notice -- Notice to Lien Agent

North Carolina, like most states, requires a form of preliminary notice to be sent to property owners or other contractors in the chain as an essential step to claiming a mechanic's lien. In North Carolina, the notice takes the form of a "Notice to Lien Agent." A lien agent (usually a title company) must be designated by statute for all non-owner occupied projects exceeding a value of $30,000. N.C.G.S. 44A-11.1. The Notice serves the purpose of providing Lien Agent with notice that the potential lien claimant is or will be providing labor, services or materials to the project property that could be the subject of a later lien claim.

The Notice to Lien Agent must include: 1) the potential lien claimant's name, address, telephone number, fax number (if available), and email address (if available); 2) the name of the party with whom the potential lien claimant contracted; 3) a description of the real property sufficient to identify it; and 4) a statement giving notice of the potential lien claimant's right to subsequently pursue a claim of lien for the improvements to the property. N.C.G.S. 44A-11.2(i).

The Notice to Lien Agent must be filed within 15 days of the potential lien claimant's first furnishing to the project property. N.C.G.S. 44A-11.2(l)(1). Serve the Notice to Lien Agent on the identified lien agent using any of the acceptable means of service in the State, although certified U.S. mail is usually the most convenient option.

Forms used, created quitclaim deed that the county accepted without a second look (turns out they see deeds.com forms regularly via erecording and in person). Will be back for any real estate related forms I need and they carry. Will always be my first stop. Also, will use erecording next time, mad I didn't see it this time.

The DEEDs website is very easy to navigate and find the required documents. I have not yet had an opportunity to review the documents I purchased and downloaded. That is the reason I have assigned a rating of four stars. I fully hope that can raise my rating to five stars after I've used those documents.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.

Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!

Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

The pdf form is good; however, the input boxes merge into the line above so the text is hard to read when complete. I added a return before entering my data and this solved the problem.
