On January 1, 2014, New Mexico joined with eleven other states to enact the Uniform Real Property Transfer on Death Act (URPTODA), found at Sections 45-6-401 through 45-6-417 NMSA 1978 (2014). This updated law enhances and adds clarity to the previous transfer on death statute already in force in the state.
Real estate owners who record a transfer on death deed (TODD) under the URPTODA retain the ability to revoke the recorded conveyance. These deeds offer a potential future interest but no guarantee of anything; the beneficiary only gains title to the property rights present when the owner dies.
Why does revocability matter? Life is unpredictable. For example, the original beneficiary may become unable or unwilling to accept the property. Marriage or divorce could alter the nature of the relationship between the owner and the intended recipient. The owner/transferor might decide to use the land another way. Regardless of the reason, the ability to cancel or modify a recorded TODD without involving the courts or restructuring their entire estate plan lets owners resolve unexpected issues in a relatively simple way.
There are three primary methods for revoking a transfer on death deed, as defined in the New Mexico Statutes at 45-6-411.
The named transferor may execute and record:
1. a statutory revocation form;
2. a new transfer on death deed that revokes all or part of a previously recorded TODD; or
3. an inter vivos deed (such as a warranty or quitclaim deed) that expressly revokes all or part of a previously recorded TODD.
Timely recording is essential for all documents dealing with ownership of real property, but it is even more important for documents associated with transfers at death. Just as with a TODD, the revocation must be recorded during the owner's life in the office of the clerk for the county in which the deed is recorded or it has no effect.
In addition to the reasons discussed above, consider filing a revocation form prior to selling real estate previously identified in a recorded transfer on death deed. Documenting the change helps to maintain a clear chain of title (ownership history) by closing out what might otherwise look like a potential claim against the property. A clear chain of title makes future transactions involving the property less complicated.
The right to revoke or modify a recorded transfer on death deed adds flexibility to a comprehensive estate plan. Executing and recording a statutory revocation form allows owners of New Mexico real estate to control the distribution of their property at death without the need for a will or probate. I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.

My sale is a land contract and it is complicated. We were thinking we'd have to get an attorney. Your site is very thorough and helpful. We will still have an attorney look over our final papers --and we are still waiting on my deed from the bank to finalize our input. The forms were immediately available for download, which was nice. However, I was not impressed by the lack of several features: 1) there was no way to edit set text in the form, such as where it says you should consult an attorney. That is not necessary for recording the deed and I wanted to deleted it, but could not. 2) Also, under the "Notes" section, there is a limited area to write; I tried adding a fuller explanation of something, but the form would not accept or include it when I printed the final document. The form may do the job, but it's not very sophisticated or elegant.

This was a seamless process. It probably took one minute to fill out my information and upload the document. It was formatted and sent immediately. It was processed the next day at the county recorders office. I have zero complaints.
Before finding this company I spent an entire day calling and leaving messages at other e-filing companies like simplfile and others but they all required subscriptions. I just needed to file a single document now and then so that was not a good fit. (And those companies I found out still require the customer to do all the work!). Deeds.com kept me informed throughout the process every step.

Great service ! Hawaii is not a "forms state" so unfortunately the public has no way to get templates on our local gov site but deeds.com to the rescue.
