A personal representative is the fiduciary appointed by the County Court to administer a decedent's estate in probate. The deed transfers title to a decedent's real property to the distributee as grantee. The distributee may be a devisee under the decedent's will, or an heir with a right to succeeding interest under Nebraska's laws of intestate succession when there is no testamentary disposition.
Record a deed of distribution in the Register of Deeds office of the county where the subject property is located as proof of the distributee's succession to the decedent's interest in real property (Neb. Rev. Stat. 30-24,106). PR deeds typically recite the decedent's name and the case number assigned to the estate by the court, and expressly state that the grantor is executing the deed in a representative capacity. They must meet all requirements of form and content for documents pertaining to interest in real property in the State of Nebraska, including a complete legal description of the subject parcel. A Real Estate Transfer Form is required, but the conveyance is exempt from documentary stamp tax.

The release of mortgage form was OK, and accepted at the recorder's office, but there were some problems. Many of the fields to type in were too small to accept the data, and I could not find a way to change the field size or use a smaller font. Otherwise I was satisfied.

This was such a money saver. I was told by someone at the courthouse that I had to have a lawyer prepare the paper work for my mom. They stated that family members couldn't prepare the papers. I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.
