Securing a Nebraska Construction Lien

Construction liens are governed under the Nebraska Construction Lien Act, found at Sections 52-125 to 52-159 of the Nebraska Revised Statutes.

A lien is a legal right or interest in property, held by a creditor until the debtor pays the amount due on account. Construction liens are often used to persuade an owner or other party to pay a contractor the balance owed for work on real property. For instance, if a contractor who completed a project is waiting for payment, a lien might make sense. Because liens prevent an owner from selling or refinancing a property (or make it difficult to do so), they offer an effective remedy for contractors and other eligible parties.

A claimant may record a lien which shall be signed by the claimant and state: (a) The real estate subject to the lien, with a description thereof sufficient for identification; (b) The name of the person against whose interest in the real estate a lien is claimed; (c) The name and address of the claimant; (d) The name and address of the person with whom the claimant contracted; (e) A general description of the services performed or to be performed or materials furnished or to be furnished for the improvement and the contract price thereof; (f) The amount unpaid, whether or not due, to the claimant for the services or materials or if no amount is fixed by the contract a good faith estimate of the amount designated as an estimate; and (g) The time the last services or materials were furnished or if that time has not yet occurred, an estimate of the time. Neb. Rev. Stat. 52-147(1).

In Nebraska, construction liens are recorded with the county recorder's office within the bounds of the county where the property is located. A recorded lien remains enforceable for two (2) years after its recordation. Neb. Rev. Stat. 52-140. Note that in addition to the statutory content requirements, the lien form must meet all state and local standards for recorded documents.

The release of mortgage form was OK, and accepted at the recorder's office, but there were some problems. Many of the fields to type in were too small to accept the data, and I could not find a way to change the field size or use a smaller font. Otherwise I was satisfied.

Death of JT form was excellent. You have the best documents out there. I wish I could have read the sample just so I knew my information was entered correctly. Real problem is County wants a bar code on documents to get recorded. Now?
Need four deed forms so the expense starts to be prohibitive. I would rather pay more and get multiple access.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.

Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!

Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.
