The Montana Uniform Probate Code (UPC), codified under Title 72 of the Montana Code, governs probate in that state.

A personal representative's deed is a fiduciary instrument used to convey real property from an estate to a purchaser. A personal representative (PR), who may also be referred to as an executor or an administrator, is the person appointed to manage the decedent's estate.

PR deeds must meet all state and local standards, and may require supporting information, depending on the situation. Record the completed deed of distribution in the county clerk/recorder's office of the county wherein the subject property is located to transfer title.

Execute a PR deed pursuant to a court order for sale when partition among multiple distributees cannot be conveniently made; to facilitate payment of the estate's debts; or as directed by the decedent's will. The personal representative need not seek approval to complete any transaction authorized by the UPC under 72-3-613, including sales of real property, unless the estate is subject to formal probate.

Overall positive experience; especially liked immediate access to downloaded documents and instructions. My only concern was lack of adequate space in portions of your beneficiary deed blank form which then required me to use 3 exhibits to complete all necessary documents for the county recorders office. My overall experience was positive. Little trouble uploading documents but resolved. I had two mineral deeds to file in Arkansas, two different counties, exactly the same form, only difference being property description; one was completed, one was canceled. I emailed to inquire why and the reply was in an automatic email indicating that email address was not monitored and if further action would be taken on Deeds.com part, I would be notified. Other than that, I would recommend their services to avoid using snail mail.

The forms were immediately available for download, which was nice. However, I was not impressed by the lack of several features: 1) there was no way to edit set text in the form, such as where it says you should consult an attorney. That is not necessary for recording the deed and I wanted to deleted it, but could not. 2) Also, under the "Notes" section, there is a limited area to write; I tried adding a fuller explanation of something, but the form would not accept or include it when I printed the final document. The form may do the job, but it's not very sophisticated or elegant.
