The Idaho Trustee's Deed Upon Sale is codified at I.C. 45-1509.
A trustee uses a trustee's deed upon sale to convey real property sold at a trustee's sale following foreclosure under a deed of trust. A deed of trust is a security instrument that, along with a promissory note, sets out the terms for repaying a loan used to purchase real property. Some states use deeds of trust in the place of mortgages.
The three parties involved in a deed of trust are the lender, the borrower (the grantor under the deed of trust), and the trustee. The trustee is generally a title insurance agent who holds legal title to the real property until the borrower has fulfilled the obligation of the deed of trust. The borrower holds equitable title.
If the borrower defaults on the terms of the deed of trust, the trustee, under the direction of the lender, may act on the power of sale clause in the deed, and initiate non-judicial foreclosure proceedings on the property. Statutory requirements, including the mailing of notices of default and sale, must be met before a trustee's sale is held at public auction. See I.C. Title 45 for more information.
The trustee's deed names the trustee as the grantor and conveys title to the highest bidder at the sale. In addition to describing the real property being conveyed, the deed recites basic information from the deed of trust, including the date of the instrument, the grantor's name, and a reference to where the deed can be found on record. The trustee's deed also includes references to facts about the default and the trustee's sale itself, and is recorded in the county in which the subject property is situated (I.C. 45-1509).

The release of mortgage form was OK, and accepted at the recorder's office, but there were some problems. Many of the fields to type in were too small to accept the data, and I could not find a way to change the field size or use a smaller font. Otherwise I was satisfied.

This is a very useful site for downloading legal forms - just be sure you're getting the form you need before buying.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.
Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!
Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

This is an option for recording that worked flawlessly with my county government. Given Covid19 has closed county offices to the public as well as the personal kiosks options to record shrunk dramatically. I recommend Deeds.Com for your recording needs.

As a first time user and not having knowledge of how your site worked it was awkward to upload a file and not know what to do next. I found out there is nothing to do next but that after some time looking for a submit button or some kind of confirmation that I was doing the right thing. Ended up being very easy, just wasted time trying to figure out what to do when there was nothing left to do.
