Commonly, when people create their wills, they identify one or more individuals to supervise the distribution of their assets. The person who fills this role is called an executor. An executor uses an assent to devise to transfer real property from the decedent's estate to beneficiaries named in the decedent's will.

Under Georgia law, "title to property in the estate does not pass to the heirs or beneficiaries until the personal representative assents thereto" (OCGA 53-8-15).

Record the completed assent to devise, along with any necessary supporting documents, with the real property records of the appropriate county. This shows that the executor assents to the passing of title from the decedent to the beneficiary.

Forms used, created quitclaim deed that the county accepted without a second look (turns out they see deeds.com forms regularly via erecording and in person). It is easy to use but difficult to know when the document has been reviewed for recording and when the invoice is ready. It would be helpful for the website to send an email automatically once the document(s) are ready to be recorded to let you know what the time line is.....Thank you for your help.

The Transfer on Death Deed form package was very good. But like anything, could use some improvements.

There is not enough space to fill more than one beneficiary with any level of additional detail like "as his sole and separate property"

The area for the legal description could be a bit bigger and potentially fit many legal descriptions. Or it could be made to simply say "See Exhibit A" as is likely necessary for most anyway.

The guide should indicate what "homestead property" means so the user doesn't have to research the legal definition. (which turns out to be obvious, at least in my state, if you live there, it's your homestead.)

It would be helpful if an "Affidavit of Death" form were included in the package for instances where the current deed hasn't been updated to reflect a widowed owner as the sole owner before recording with only the one signature.
