Warranty deeds in Florida are used to create, grant, transfer, or release an estate or interest of freehold. Any conveyance of real estate in Florida is required to be in writing and signed by the grantor (or by the grantor's lawfully authorized agent) in the presence of two subscribing witnesses (689.01). A statutory form for a warranty deed is provided in section 689.02 of the Florida Statutes. The grantor to a warranty deed offers a covenant of full warranty to the title of the land being conveyed, and will defend the same against the lawful claims of all persons (689.02). The warranty deed is used for many real estate transactions in Florida. It is sometimes referred to as a general warranty deed.
In order for recording to take place, the execution of a warranty deed must be acknowledged by the party executing it, proved by a subscribing witness, or legalized or authenticated by a civil-law notary or notary public who affixes his or her official seal before the officers in the manner provided by law (695.03). The grantor's signature requires two witnesses; however, the notary public can be one of the witnesses, but the notary must then sign the document twice: both as a notary and as a witness. Acknowledgements can be made in Florida or in another state by any of the officers listed in 695.03 of the Florida Statutes. A certificate of acknowledgement or proof, under the seal of the court or officer taking acknowledgements, should be attached to the warranty deed presented for recording.
A warranty deed for the conveyance of real property or interest in real property will not be good and effectual in law or in equity against creditors or subsequent purchasers for a valuable consideration and without notice, unless it is recorded according to law (695.01). The priority of documents is determined by the order and time of recording. Warranty deeds and all other real estate documents are recorded with the clerk of the circuit court in the county where the property is located.

Forms used, created quitclaim deed that the county accepted without a second look (turns out they see deeds.com forms regularly via erecording and in person). Will be back for any real estate related forms I need and they carry. Will always be my first stop. Also, will use erecording next time, mad I didn't see it this time.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.
Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!
Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

This was such an easy process and even tho you had to pay a $15 - to me it was well worth not having to drive downtown etc or take the risk of mailing the documents (fearing that they would get lost). I'll be using this from now on...

I have been researching for months to figure out how to remove deceased owner of property with right of survivorship in Florida. The County Clerk was not helpful. They refer you to get legal advice which is expensive. So hopefully by completing these forms I can actually complete the task. And would be helpful to be reassured that this is all I need to complete overdue task. I was hesitant to pay, but I believe this is legit. If so- a great Thank you.
