Used in trust administration, a trustee's deed conveys real property out of a trust and vests title in the name of a grantee. Unlike other instruments of conveyance, this deed is named for the person executing the deed rather than the type of transfer it is.

A trustee is the person who holds legal title to trust property in the name of the trust. The trustee is appointed in the trust instrument, an unrecorded document executed by a trustor, who funds a trust with assets. The powers of the trustee relevant to the conveyance of real property are also enumerated in the trust instrument.

The trustee's deed follows the statutory form for conveyances of real property in Delaware (Del. Code tit. 29, 121(a)). Pursuant to Del. Code tit. 29, 121(b), the deed functions like a special warranty deed, meaning it carries a warranty of title only for the duration of the current grantor's ownership of the property.

Under a trustee's deed, the trustee is named as the grantor, and basic information about the trust under which the trustee is acting also appears. As with all instruments affecting real property, the trustee's deed requires a legal description of the subject property. All acting trustees named under the trust instrument as required to sign must sign the deed in the presence of a notary public for a legal transfer. The deed is then recorded in the county in which the subject property is situated. Also, note that each of Delaware's three counties specify different deed format requirements, so make sure to use the correct layout for the property's location.

The release of mortgage form was OK, and accepted at the recorder's office, but there were some problems. Many of the fields to type in were too small to accept the data, and I could not find a way to change the field size or use a smaller font. Otherwise I was satisfied.

If I hadn't spent my career as an escrow officer (albeit in another state), I may have had a hard time figuring out exactly which deed I needed and how to prepare them, even with the back-up informational, how-to pdf documents, without an attorney. My experience speaks to how much the general public doesn't understand and how confusing it can be. Nonetheless, the access to so many documents at a fairly reasonable cost, the basic how-to docs made available along with the purchased doc makes all the difference. I appreciate having such things available to the public. Many thanks.

The forms were immediately available for download, which was nice. However, I was not impressed by the lack of several features: 1) there was no way to edit set text in the form, such as where it says you should consult an attorney. That is not necessary for recording the deed and I wanted to deleted it, but could not. 2) Also, under the "Notes" section, there is a limited area to write; I tried adding a fuller explanation of something, but the form would not accept or include it when I printed the final document. The form may do the job, but it's not very sophisticated or elegant.

I purchased a Warranty Deed "package" on Friday and found that the Main download was a working document, but the secondary document (which is required) was not. In other words, I was able to use the fill-in feature on the main document, but not on the second document. I used the portal on the website to report my issue the same day. That was Friday. This is Wednesday. I have not heard a word from them and I have to use my documents in 2 days. I will probably have to resort to pen and ink for that document, but I have already tried filling it out twice and have to keep reprinting and starting over. You can't white out or cross out. I would really prefer to have the complete service that I paid for.

Over all quality of document was good. The issue I had was where it states claimant did not have a contract with the owner or their agent. I did have a contract with their agent, and there was no option for both. So had improvise.
