This form is for use by authorized personal representatives to convey real property.

The statutory form for a conveyance of real property in Delaware is a special warranty deed. In a personal representative's deed, the administrator or executor is the grantor, conveying all the title that the decedent had at the time of death to the grantee. The terms "grant and convey" warrant the title against the grantor and all persons claiming under the grantor (25 Del. Co. 121). In addition to requirements of a statutory deed, the personal representative's deed includes information about the decedent, including name, date of death, and information regarding the open estate.

The personal representative signs the deed in the presence of a notarial official and records the deed and all necessary supporting documents in the Recorder of Deeds office where the property subject to transfer is located.

If I hadn't spent my career as an escrow officer (albeit in another state), I may have had a hard time figuring out exactly which deed I needed and how to prepare them, even with the back-up informational, how-to pdf documents, without an attorney. My experience speaks to how much the general public doesn't understand and how confusing it can be. Nonetheless, the access to so many documents at a fairly reasonable cost, the basic how-to docs made available along with the purchased doc makes all the difference. This is an option for recording that worked flawlessly with my county government. Given Covid19 has closed county offices to the public as well as the personal kiosks options to record shrunk dramatically. I recommend Deeds.Com for your recording needs.

The download of forms, etc. was easy and the guides that were provided were good, but more information would have been nice as to where to find tax map #, parcel #, and district mentioned in Exemptions from Property Transfer Fees (and Declaration of Consideration or Value.
