Use a Colorado supplemental affidavit of deceased grantor owner to complete the transfer of real property initiated by recording a Colorado beneficiary deed.

Completing the Transfer from a Colorado Beneficiary Deed

Beneficiary deeds provide a relatively straightforward, effective way for Colorado land owners to convey real estate, after death, to one or more named beneficiaries without the need for probate. See C.R.S. 15-15-401 et seq.

State law provides that title "to the interest in real property transferred by a beneficiary deed shall vest in the designated grantee-beneficiary only on the death of the owner" (15-15-407(1)). The beneficiary should offer proof "of the death of the owner or a grantee-beneficiary... in the same manner as for proving the death of a joint tenant" (15-15-413). That process is specified in 38-31-102, and it involves completing and filing a supplemental affidavit, along with a copy of the decedent's death certificate, with the recorder or register of deeds for the county where the land is located. While not specifically required, it is also a good idea to include a copy of the recorded beneficiary deed.

By recording the supplemental affidavit, the beneficiary provides public notice of the change in ownership. This is important because it preserves the chain of title (ownership history), which should simplify future sales of the land.

The documents' format contained information needed to complete the necessary paperwork for filing with Georgia. However, the fields were not large enough to put the legal description in, and there was no way to enlarge the area. These were only semi-helpful in providing what I needed per Georgia's filing requirement.

First time using Deeds.com and feel that your platform is clear and easy to use. I was also pleased with the messaging center and follow-up and also surprised at how quickly our particular deed was recorded and available to view. Having said that, when I first investigated Deeds.com the fee was $15 and as of 1/1/21 it has increased to $19 which I feel is pretty steep for the handling of 1 simple document especially when the turnaround was basically the same day. Your fee was nearly the equivalent of the cost of the Clerk's recording fee. Perhaps you should offer a fee schedule for those of us who are not volume recorders. Just a thought.

I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!
