A grant deed, as a type of conveyance used in Alabama, is required to be in writing, and must be signed by the grantor. The execution of a grant deed should be attested by at least one witness, and if the party cannot write, by two witnesses who are able to write. However, a proper acknowledgment can take the place of witnesses (35-4-20).

Grant deeds are not mentioned by name in the Alabama statutes, but the deed is still in common practice in the state. A grant deed transfers property ownership from a grantor or entity to a grantee or entity. In this type of deed, the grantor promises that he/she has not transferred the title previously and that there are not any encumbrances, other than those that may be stated in the deed. In addition, a grant deed will pass after-acquired title.

A grant deed is inoperative and void as to purchasers for a valuable consideration, mortgagees, and judgment creditors without notice, unless the instrument has been recorded before the accumulation of the rights of such purchasers, mortgagees, or judgment creditors (35-4-90). Grant deeds are recorded in the office of the judge of probate in the county where the property is located. Recording serves as constructive notice of the contents of the deed.

Thank you! My husband and I went in the get notary stamps for a Special Warranty Deed and a Post Nuptial Agreement. The representative was very knowledgeable and thorough with the notary process. She made sure we read and understood all documents that we were signing and they required us to recite in sworn statements that everything there was true and understood! Easy fill in the blanks form. Just FYI make sure you have a copy of whatever deed you are changing and the tax records. You will want the language to be identical.

Guidelines somewhat helpful. Forms fillable but not editable unless you buy an Adobe conversion service subscription. End product looks crude and amateurish. Fields can't be reduced or enlarged to accommodate unique data. Very disappointing.

I didn't have any problem downloading and filling out the form on my computer and printing it yesterday. I didn't know what to put for "Source of Title". I called the county recording office; they didn't know either and said to leave it blank. I got the form notarized at my bank and took it in to the recording office. They checked it, accepted it, I paid a fee, and it's done. So easy. My children will appreciate that I've done this. Added note: You do have one typo on your form--you left out 'at'. It should read: "You should carefully read all information at the end of this form."
